Limitation of liability

The Company can be held liable, and in breach of the transportation and/or storage agreement, up to the declared value of the goods for damage or loss caused by negligence. It is the Client’s sole responsibility to declare the value of the goods in writing before entering into the agreement, so that the Company can advise on the applicable liability limits and any separate insurance requirements. A declaration of value does not itself constitute insurance or an agreement by the Company to accept liability for that amount. Any agreed additional cover must be confirmed separately in writing. The Client must provide a written inventory identifying the contents and declared value of each box or separately handled item before entering into the agreement. Any claim for loss or damage must be supported by reasonable evidence of ownership and value, such as receipts, photographs or comparable second-hand prices. A value stated only after loss or damage occurs does not, by itself, establish entitlement to compensation.

The Company shall not be liable for damage to, loss of, or total loss of goods caused by circumstances beyond its control which it could not avoid and whose consequences it could not prevent despite exercising reasonable care and taking appropriate precautions. Such circumstances include (but are not limited to) any act of God, riot, flood, fire, terrorism, theft or attempted theftβ€”including forced entry into vehicles or storage premisesβ€”and the arrest, seizure or confiscation of goods by competent authorities.

The Company will not be held liable for any damage to TVs, electronics and similar items that are not packed in their original packaging, nor for any items (or the contents of items) that were not packed by members of our team. Other than by reason of our negligence, we will not be liable for any delays in transit time.

Upon delivery, the Client (or their representative) must inspect the apparent external condition of all boxes and items in the presence of the driver. Any visible damage to the packaging, tearing, or missing items must be explicitly noted in writing on the driver’s delivery receipt at the absolute time of handover. Signing a delivery receipt without written reservations constitutes contractual proof that the goods were delivered in an acceptable condition. If a written signature is not obtained, the physical handover and taking possession of the goods at the delivery address without immediate written reservations given to the driver shall equally constitute full contractual proof of acceptable delivery. The Company will not accept liability or entertain any subsequent claims for the condition of the boxes, or any reported damage to or loss of their contents, once the delivery receipt has been completed or handover has taken place and our vehicle has left the delivery address.

Payment terms

International Shipping: For international shipping services, cleared funds are required at least 7 working days prior to your move date, and overdue balances incur interest at 4% above the Bank of England base rate.

Non-payment of storage fees

All goods are accepted for storage strictly subject to payment of storage fees in full and in advance. Any account remaining unpaid for more than 30 days from the due date shall be deemed to be in default.

In the event of default, we reserve the absolute and unrestricted right, without further notice, to retain, sell, destroy, or otherwise dispose of the stored items at our sole discretion in order to recover outstanding fees and associated costs.

Upon default, the customer irrevocably forfeits any right, title, or claim to the stored items and expressly waives any claim for loss, damage, or compensation arising from their disposal or sale.

Disposal or sale of the items does not extinguish the customer’s financial liability. All outstanding storage fees, accrued charges, disposal costs, and any legal, recovery, or administrative costs incurred shall remain payable in full. We reserve the right to pursue recovery of any unpaid amounts through legal proceedings.

Is my stuff insured?

All goods are carried under standard CMR conditions. The Company will not be held responsible or liable for any item worth more than Β£50 without insurance. An individual item means each separately handled article, including all its contents. If you require cover for a higher value, we recommend arranging separate insurance through an independent insurer before collection. Please see the β€˜Limitation of Liability’ section for inventory, value declaration and supporting evidence requirements.
